A Doctor of Jurisprudence degree from an ABA-accredited law school is required.


Applicants are required to be members of the Florida Bar.


Additional requirements:

  • Three (3) or more years of professional experience in the practice of law, legal research and in administrative and judicial hearings, which includes experience before the Florida Division of Administrative Hearings (DOAH), and with Chapter 120, Florida Statutes, and rule chapter 28-106, Florida Administrative Code.
  • Candidate must have practical experience applying the Florida Rules of Civil Procedure; with the Florida Rules of Evidence; and must possess strong writing skills.

Preference will be given to applicants with:

  • Experience practicing administrative law within a state government agency in the areas of licensing and regulation.
  • Has acted as lead counsel in three (3) or more administrative hearings or state court trials which were litigated to conclusion.
  • Experience in securities, financial services or financial institutions law.
  • Possesses a Board certification by the Florida Bar in State and Federal Administrative Law.

This position may require 1 – 25% travel, and more depending on the selected candidate’s primary office location. A valid driver’s license is required.


Work samples may be requested to verify competence.


The anticipated salary range for this position is $65,000.00 to $75,000.00. The starting salary shall be commensurate with the selected candidate’s competencies and qualifications.


Employees of the Department of Financial Services (DFS), which include employees of the OFR, are paid on a monthly pay cycle.

The OFR operates from five (5) different office facilities throughout the state of Florida, including Tallahassee (Headquarters), Miami, Orlando, Tampa, and West Palm Beach. The OFR may consider any of these office locations as the primary reporting office location.


The Office of Financial Regulation (OFR) is responsible for licensing, chartering, examining, and regulating depository and non-depository financial institutions and financial service companies, including state-chartered banks, credit unions, trust companies, loan originators, mortgage lenders, securities dealers, investment advisors, consumer collection agencies and money transmitters throughout the state of Florida.


The Office of General Counsel (OGC) is structured by Litigation Support Civil/Appeals Primary, Litigation Support Administrative Primary, Legal Support/Intake and Administrative Support Services. The incumbent of this position may be assigned to assist one or more areas from time-to-time in support of the mission of the OFR. The incumbent may be required to specialize in the laws affecting one or more areas under the jurisdiction of the OFR including but not limited to financial institutions, securities regulation, and consumer finance related regulation.

No applicant may begin employment until the background screening results are received, reviewed for any disqualifying offenses, and approved by the Agency. Background screening shall include, but not be limited to, fingerprinting for State and Federal criminal records checks through the Florida Department of Law Enforcement (FDLE) and Federal Bureau of Investigation (FBI) and may include local criminal history checks through local law enforcement agencies.


Minimum Qualifications for this position include the following REQUIRED ENTRY LEVEL KNOWLEDGE, SKILLS AND ABILITIES:

  • Knowledge and experience of Chapter 120, Florida Statutes.
  • Knowledge and experience with appellate, civil, and administrative litigation.
  • Ability to understand and apply laws, rules, regulations, policies, and procedures.
  • Ability to conduct research and prepare reports.
  • Ability to utilize problem-solving techniques.
  • Ability to communicate effectively orally and in writing.
  • Ability to work under pressure and be results oriented.
  • Ability to establish and maintain effective working relationships with others.
  • Ability to work independently and in a team environment; and
  • Must be computer literate and familiar with Microsoft software (including Word, Excel, Outlook, Power Point and Teams) and Adobe Acrobat Professional.

OTHER KSAs (Incumbent may learn on job):

  • Effectively utilize agency hardware and software programs including proficient utilization of the REAL system.

DESCRIPTION OF DUTIES AND RESPONSIBILTIES:

Renders legal advice and counsel to agency personnel on OFR policies and regulations, legislative matters, statutory interpretations, and rule promulgation, which require significant legal experience and the exercise of independent judgment.


Drafts contracts, proposed orders, declaratory statements, written agreements, correspondence, and other related documents regarding matters within the jurisdiction of the OFR or determines compliance with applicable state and federal laws as to documents drafted by others. Conducts independent and varied legal research requiring sound legal analysis and the exercise of independent judgment in evaluating state statutes, federal statutes, and constitutional issues. Subsequent to research, will prepare legal opinions and memoranda for use throughout the OFR.


Provides cooperation and assistance to Assistant State Attorneys, Assistant Statewide Prosecutors, Assistant U.S. Attorneys and law enforcement agencies concerning criminal enforcement matters which may result from investigations conducted by the OFR into alleged violations of the state banking, securities, and finance laws or related statutes and provides assistance and cooperation to other state and federal governmental agencies concerning civil or administrative actions related to alleged violations of matters within the jurisdiction of the OFR.
